This is in response to a request in Feb. regarding trust property in the
dissolution of marriage. I cannot be a much help to you but I know that this
has come up in tax cases and in other divorce cases. And I remember some years
back (early 1980s) when a court in South Dakota (maybe N.Dakota) actually
gave the non-Indian spouse the rights to reservation property. For some
reason I think it was related to a tax case, I can't find a reference to it,
but try the Indian Law Reporter for the early 80s and look for a Dakota case
where both parties have the same name.
