Warriors Appeal Conviction, say judge misdirected jury

Two Mohawk Warriors sentenced this week to jail for their part in the
1990 Oka crisis are appealing their convictions.
A lawyer for both Warriors, is appealling because of 16 errors in law.
Lawyer Peris arugues that Judg Greenberg should have dismmised all charges
because the proseution failed to provide the defence with all its evidence in
a candid and timely way. Also for the fact that the Army and SQ wouldn't turn
over the 200 tapes of the Oka crisis.
He also argues that the judge should have drop all nine charges from
the assault on a fomer councillor and his son. As the prosecuter failed to
call the son and onther witness to the incident. In so doing dnying Cross to
make a full defence.
He also argues that Cross should have been tried sparately on what is
known as the army offences.
Also Greenberg in his instruction to the jury he selective reference to
the evidence in a way that favoured the prosecution. That he aslo dismantled
defences that had been rasied through cross-examination. He also did not
explain the concept of self defence and offered the jury his speculations of
unsupported by evidence.

I would like to had a point about the lenght of the sentence. Yes these
two Warriors did do some things that were not surpported by the people but the
lenght of time in prison is just out of the ball park.

We have a guy that throws rocks at cars and gave a man a heart attack
and dies a $500 fine. Plus no record so that he can join the Army or the
Police Force in Quebec.
We have a hit and runner diver that Killed Victor Davis, and he gets 15
months for this crime.
We have two teenages that kill a driver in a hit and run. One gets a
year and the other get 15 days.

So where is the Justice in Quebec ?

I say their is no JUSTICE IN QUEBEC. It would have been better off if they
had just open fire and taken out the attack. That way they would have 1 to 3
years or less by claiming self defence. Its funny the worst the crime, the
less the time.
