There was a long article in Sunday's Columbus Dispatch about this.
The situation described by the paper is more or less what you
describe, only it's not clear that the surrounding land is sacred to
anyone, since the people who built the Serpent Mound are long gone.
The burial and village sites though are in invaluable archaeological
resource, and there is the fear that the development will damage the
mound itself. I can get more details from the paper if anyone is
interested.
