The executive director of the Kimberley Land Council has
announced that they will mount a High Court challenge to the
Act. A report by Duncan Graham in the Sydney Morning Herald
states:
The Western Australian Land (Titles and Traditional
Usage) Act extinguishes native title and replaces it with
statutory rights to use of land. It does not provide
ownership rights.
"This legislation places the rights of Aboriginal people
under the control of a minister of the State," Mr Yu
said.
"No other Western Australian is forced into such a
subservient position. This legislation ignores the
reality that native title exists as a common law right
for the people who are the original owners of the
country."
