I would appreciate assistance from network subscribers regarding the
legal "scope and nature" of Alodial Title, a legal term used to
denote land that is "sacred, undivided common interest of the people
to the resources" of the given area.
Currently, "Indian Canyon", near Holister, California, indigenous
land legally occupied by decendants of Native peoples is endangered
by an adjacent land owner who has developed two water wells next to
Indian Canyon Creek. The creek has also been dammed. These combined
intrusions have had detrimental effects on the Canyon's only water
supply and on the vegetation and residents of the Canyon. The area
is actively used for general living as well as ceremonial activities.
Information about similar legal cases or law suits would be useful to
the Ohlone people involved with the protection of this area. Of
particular interest is information concerning the possible use of the
term and legal parameters surrounding "Alodial Title".
