URGENT ACTION -
STATE OF EMERGENCY IN BRITISH COLUMBIA, BRAZIL OF THE
NORTH
Timber West, a subsidiary of Fletcher Challenge Ltd, recently
announced a five year cutting plan which will utterly
devastate the unceded Carmanah-Walbran territories of the
Independent State of Qwa-Ba-Diwa on southern Vancouver
island.
Simultaneously the B.C. Treaty Commission is commencing
negotiations with Department of Indian Affairs (DIA) puppet
Band Councils in a grotesque and fraudulent attempt to have
these 'crown agents' surrender title in exchange for monies,
and 'self government agreements' which transform sovereign
indigenous nations into internal colonies with municipal
status - subservient to both the federal and provincial
governments of the Canadian settler state.
THE B.C. TREATY COMMISSION
A Statement of Intent to Negotiate was recently filed by the
Laichkwiltach Treaty Council, composed of that Nation's
hereditary chiefs. The application was rejected as
"inconsistent with the negotiation process followed by the B.C.
Treaty Commission Agreement". Reasons for the rejection
included overlapping statements submitted by the DIA-imposed
puppet Band Councils. "It is our opinion that the Statements of
Intent from these recognized and established First Nations
communities accurately represent the aboriginal population in
the claim area." Another reason was "...you indicate that the
Laichkwiltach Nation seeks bilateral and international
treaties. The B.C. Treaty Commission is a tripartite process to
resolve claims within the province of B.C."
According to Dr. Bruce Clark, a recognized expert in this area
of Canadian law, under the B.C. Treaty Commission native
sovereignty and jurisdiction protected under Canadian
constitutional law is being sold out by native traitors, or by
lawyers misleading innocent and confused native leaders, or by
a combination of both, and by the non-native courts and
governments that are breaking a sacred trust to protect and
uphold existing law.
The largest repository of unceded (unsurrendered) territory in
North America is about to be stolen via a process of fraud,
chicanery and collaboration.
CLAYOQUOT SOUND: THE INTERIM MEASURES AGREEMENT
A preview of this abomination is the Interim Measures
Agreement between the provincial government of Mike
Harcourt and the NDP, and the Hereditary Chiefs of the
Clayoquot Sound region of Vancouver Island. This agreement is
being used by Harcourt to dissuade Europeans from boycotting
B.C pulp. On tour with Harcourt was the collaborator George
Watts, a director of B.C. Hydro, and until recently chairman of
the Nuu-Chah-Nulth Tribal Council. The Interim Measures
Agreement is a sad little sell-out and was reacted strongly to
in a statement issued by the Hereditary Chiefs of the Nuxalk
Nation:
"On Dec 16, 1993, the Nuu-Chah-Nulth Tribal Council somehow
talked their Hereditary Chiefs into signing a 1.25 million
dollar agreement with the B.C. Government. This allows Mac
Blo to continue logging in Clayoquot Sound...It seems the
unestablished government is being successful at pacifying the
voice of the Indian." (Especially in an area that has gained
international respect and recognition...)
"There will be an international movement to get the Province
to shed a little light on all the good they are doing for the
'Indian': telling people around the world they have now resolved
the issue in Clayoquot Sound and that they plan to proceed with
logging plans. Can everyone not see what this struggle is
about? It is about protecting Our Ancient and Sacred Forests!!
It is about survival!...Then why? Why should we trade this off
for financial power??"
OKANAGAN NATION: BC TREATY COMMISSION NEGOTIATIONS
REJECTED
On Wednesday February 2 members of the Okanagan nation
disrupted the first set of negotiations between the B.C. Treaty
Commission and DIA Band Chief Robert Louie of the Westbank
Indian band. "We consider today's meeting to be improper,
unethical and illegitimate," said Grand Chief Archie Jack of the
Okanagan Tribal Council. Neither Westbank Indian Band
members nor the Okanagan native people have endorsed or
sanctioned the B.C. Treaty Commission process. "This
impropriety is totally unacceptable and will not be tolerated.
"We don't want our traditional lands turned into
municipalities, into industrial parks, fully populated with non-
native people," said Donna Goodwater from the Vernon band.
Pierre Kruger asked Commissioner Connaghan: "...will you
participate further in this Crown treason? People are dying for
their freedom all over the world. If that's what it takes, we
too will start dying for our freedom - and one of these days
we'll have our own Nuremburg trials!"
LIL'WAT: THE DEVASTATION CONTINUES
In southwestern B.C. on Lil'wat territory -- the traditional
watchman of the Lil'wat Nation, Chubb Pascal, reports
devastation of Lil'wat grave sites and sacred places is ongoing.
To date pictographs have been blasted and grave sites
bulldozed as roadbuilding proceeds into the last of the Lilwat's
ancient Old Growth Forest.
Clearcutting of valley walls has caused flooding three times in
the last ten years. A big slide is feared. Pesticides and
herbicides used in the area have left deer covered with
cancerous lesions. Fishermen report salmon that literally glow
in the dark as they hang from the drying racks.
Previous peaceful protests and requests for honorable nation-
to-nation negotiations have been met with brutal raids and
beatings by the RCMP, media demonization as 'extremists' and
a settler court system which continues to criminalize the
traditional Lil'wat people - who with their lawyer Dr. Bruce
Clark are alleging massive fraud on the part of provincial and
federal authorities to usurp native jurisdiction over
unsurrendered territories and as a result have arguably and
demonstrably committed the crimes of ecocide and genocide.
Mainstream environmental organizations like Greenpeace,
Sierra Club and Western Canada Wilderness Committee have
declined to assist sovereigntist traditional people - aligning
themselves solely with the imposed DIA Band Council system.
Recently the Conservation Alliance of B.C., an umbrella
organization whose membership includes some of B.C.'s most
prominent environmental leadership, appointed the senior
partner of the law firm Russel & DuMoulin as their executive
director. Russel & DuMoulin specializes in jurisdiction cases
and is under contract to the B.C. government to fight the
Lil'wat sovereignty struggle. This firm is also a sponsor of the
B.C. Forest Alliance, the industry lobby set up by the PR giant
Burson-Marstellar.
It is imperative that the Lil'wat Nation be supported. The
judicial conspiracy to stonewall the Lil'wat sovereignty case
is well documented. The situation is desperate and critical. A
coordinated and monolithic media blackout on the longstanding
Lil'wat struggle continues.
STOP THE DESTRUCTION OF OUR ANCIENT BURIAL SITES AND
SACRED PLACES!
Please help the Lil'wat defend their sovereignty and their land
in any way you can. Monies for legal defence, donations of non-
perishable food items, video cameras, letters of support and
solidarity, sympathetic media, a boycott of B.C. forest
products...

The law has to be abided by the Canadians so that we can live
our way of life in peace, friendship, and respect as the Creator
has guided us to do.
We are not asking anyone for our sovereignty; it is protected
by the Law. We traditional people have always known that the
greed of the corporations seem to be a way of life for many.
We are also aware how these corporations control the so-
called democratic government of the Canadians. To be silent is
to be an accomplice to the destruction.
