I am very new to the group, and this is only my second reply, so I would
ask that you please excuse any mistakes. The only thing I know of for
this time period is a book by Robert A. Williams, Jr., called The
American Indian in Western Legal Thought (1990). The book stops in 1802
with the Johnson v. McIntosh decision. It probably does not discuss
exactly what you are after, but as I recall it has a rather extensive
bibliography. The biblio might be of use. Good Luck.
