There could be many legal doctrines which I believe could be "traceable
to prejudice against Indian people"--one part of your question. The other
part; a legal doctrine which could "serve as a vehicle for achieving justice
between Indian tribes and the dominant society", may not necessarily be the
same doctrine.

I would love to venture some thoughts on the topic but would like to pull
more information from you if you could offer any more, such as: do you
intend to use the legal arguments in a legal battle, do you want to write
about it, to what purpose would you need the information, etc.?
