A motion was filed yesterday to reopen the case of Indian activist Leonard
Peltier, who is serving life sentences in the deaths of two FBI agents 20 years
ago.
In papers filed with the federal Court of Appeals, attorney William Kunstler
said a ruling that upheld Peltier's 1985 convictions was based partly on a
misconception.
Kunstler argued the three-judge panel thought a prosecution witness had placed
Peltier near the dead agents' car June 26, 1975, the day they were killed. He
said the mistaken impression was not corrected in court by either Peltier's
lawyers or the government.
