Although I have not done any research on this issue, I did take a Water
Law class in law school, and we did do a section on Indian water rights.
I have two suggestions, both of which probably involve a law library:
First, you should check out a textbook by Joseph Sax called (I think)
Legal Control of Water Resources. Second, I think quite a few law review
articles have been published on this topic. There are both paper and
computerized indexes to these articles, which a reference librarian can
help you use.

I suggest that others who would like to answer questions posed by Franke
Wilmer's students do so by writing to the students individually, using the
addresses you'll find in the "Original Sender:" lines of their articles.
Perhaps the students could write articles at the completion of their
studies to summarize the responses they got and to tell us something about
the major conclusions they've come to in the course of conducting those
studies. Thanks.
