Summation of the three resolutions passed by the Leech Lake General
Assembly, August 23, 1996:
The WHEREASES:
A state of emergency exists on the Leech lake Reservation where the welfare
and safety of the reservation's membership is at risk due to the breakdown
of government known as the Leech Lake Reservation Business Committee
To protect the Reservation's resources it has become necessay to enact the
the Leech Lake Reservation General Council
The Leech Lake Reservation General Council is the only duly elected and
true representative governing body of the Leech Lake Reservation
The Leech Lake Reservation General Council is comprised of the
Representatives of each of the individual Local Indian Councils
representing the following communities of : Ball Club, Bena, Cass Lake,
Inger, Kego Lake/Smokey Point, Minneapolis/St. Paul, Mission, Oak Point,
Onigum, Pennigton, Sq--w Lake and Sugar Point
The Leech Lake Reservation Genral Council has adopted Resoulution 96-01
which delegates jurisdiction to the General Council regarding matters of
self-determination on controversies concerning governing documents of the
Leech Lake Band of Chippewa Indians
The Leech Lake Reservation General Council through its officers and
representative does authorize an action under the name of the Leech Lake
General Council
The recent actions of the Secretay/Treasurer, District I Representative,
District II Representative, and District III Representative of the
Reservation Business Committe have created a need for a definitive
interpretation of the governing documents of the band
THE RESOLUTIONS:
#96-07
An action to be filed pursuant to Treaties - (1826, 1837, 1842, 1847, 1854,
and 1855) and Article XIII of the Minnesota Chippewa Tribe constitution in
the Federal Judicial Jurisdiction Court naming the Leech Laqke Reservation
General Council as the Plaintiff and Secretary/Treasurer Daniel S. Brown,
District I Representative Alfred Fairbanks, Jr., District II Representative
Jack H. Seeyle, District III Represtative Myron F. Ellis as the Defendents,
such action to seek a declaration of the relative authorities iof the Leech
Lake Reservation General Council and its Local Indian Council to further
request an interpretation of the authorities and duties of officers of the
Leech Lake Business Committee
ADDITIONAL WHEREASES:
Persuant to Articl VI, Section 1, of the By Laws of the Minnesota Chippew
Tribe Constitution the Chairman and Secretary/Treasurer are vest with the
duty to countersign all warrents
The Leech Lake Reservation Business Committee Secretary/Treasurer, Daniel
Brown, has been convicted of a felony and as such cannot serve in this
capacity

The Leech Lake Reservation General Council does hereby instruct all
financial institutions to recognize the endorsement of the Chairman Eli
Hunt along with Eunice Fineday, Secretary/Treasurer of the Leech Lake
Reservation General Council on all warrents drawn in the name of the Leech
Lake Reservation Business Committee (dba Leech Lake Reservation Tribal
Council)
The endorsements of District I & II Representatives Alfred Fairbanks, Jr.
and Jack Seelye are not vaild and shall not be honored on any warrents
drawn in the the name ofthe Leech Lake Reservation Business Committee (dba
Leech Lake Reservation Tribal Council)
ADDITIONAL WHEREASES;
The Leech Lake Reservation Business Committes Secretary/Treasurer and
District III Representaives have been convicte4d of a felony and gross
misdemeanor mishandling of Tribal resources
The convictions preclude them from serving as Reservation Buesiness
Committe members on the Leech Lake Reservation as defined by the Minnesota
Chippewa Tribe Constitution Pursuant to Article 10, Section 2

The Leech Lake Reservation General Council does hereby order the immediate
removal of Daniel Brown, Secretary/Treasurer and District III
Representative of the Leech Lake Reservation Business Committee

The ball is now in the courts of the Tribal Executive Committee of the
Minnesota Chippewa Tribe; the Bureau of Indian Affairs and the Bank of
Cass Lake.
