State won't step into Perfect Title deed disputes

Perfect Title Co. uses Kingdom of Hawaii law to do land title research, and
records title reports at the state Bureau of Conveyances, casting clouds on
ownership deeds for individual parcels, blocking land sales in some cases.
Now legislation has been proposed by members of the title guarantee
industry to "resolve" the issue, and some have even called for criminal
charges and jailing of Perfect Title Co. officials.
Perfect Title officials say their critics are misdirected. Hawaii's title
insurers are leading the opposition because they can't disprove Perfect
Title's findings, which trace ownership to the days of King Kamehameha III,
and face huge liability if titles are deemed invalid, the company says.
"Everybody is trying to paint Perfect Title as the bad guys, but it's not
our fault if someone didn't do a full search of historical public records"
to check land titles, said David Keanu Sai, a company official.

Pai Ohana faces eviction from National Park

Members of a Native Hawaiian family who claim a section of a national park
in Kona is their ancestral land have been told by park officials to leave
now or be evicted.
Mahealani Pai, spokesman for the Pai Ohana ... said the family has re-
asserted its right to remain on land he says his ancestors have been
caretakers of since the I7OOs. "Why should we?" Pai said. "What would you do?"

A spokesman for the Pai Ohana says talks with the National Park Service
broke down...
Mahealani Pai also now asserts that the National Park Service (NPS) cannot
evict his family from Kaloko-Honokohau National Cultural Park because the
federal government does not have clear title to property.
Pai maintains his family has in inextinguishable right to live there because
he and his ancestors have overseen the care of the area for 14 generations.
Pai also presented documentation by Perfect Title Co. of Honolulu that
supports his position that the NPS's claim to [the area] is null and void.
